In any fight regarding which split of the fork is the "true" chain, the financial institutions ultimately get to decide because they are the ones who will pick which chain get's the BTC label on all the interfaces and which doesn't.
There's no universe where BTC is split into an egalitarian BTC1 and BTC2 and they just let the community fight it out. All the software and interfaces will want to retain the BTC ticker and the institutions will signal ahead of time which chain that will be. It's a bit of the tail wagging the dog, but nobody is signing up for unnecessary levels of Y2Kesque software prep for no reason.

the issue with freezing is that the obvious question is
whose next in line to have their funds frozen?
because there will be a next, there always is.
